Departmental Functions
Administer cyberdebt and bankruptcy affairs in accordance with the Insolvency Act 1967 [Act 306] and the Insolvency Rules 2017;
Perform functions as Provisional Liquidator or Liquidator appointed for companies that are wound up in accordance with the provisions of the Companies Act 2016 [Act 777] and the Companies (Winding Up) Rules 1972;
Administering the affairs of dissolved societies in accordance with the Societies Act 1966 and the Societies Regulations 1984;
Administer trade union affairs in accordance with the Trade Union Act 1959 and the Trade Union Regulations 1959;
Conduct investigations and law enforcement in relation to any suspected offenses committed by the bankrupt or company directors under the Insolvency Act 1967, the Companies Act 2016, the Organizations Act 1966, the Trade Union Act 1959 and under any other legislation relating to the bankruptcy or winding up of a company;
Prosecuting all types of criminal and quasi-criminal cases under the Insolvency Act 1967 and the Companies Act 2016;
Be a source of reference to the Department and the Government regarding any legal problems regarding bankruptcy or winding up of companies that arise;
Representing the Government, Department, bankrupt and liquidated companies in all civil trials in court;
Providing search services for individual bankruptcy status and company status;
Manage the Department’s financial affairs and insolvency accounting and carry out revenue activities on behalf of the Government through sources under the control permitted under the Insolvency Act 1967, the Companies Act 2016, the Financial Events Act 1957 [Act 61] or Treasury Directives;
Manage and supervise the administration of the Head Office and all branch offices of the Malaysian Insolvency Department throughout Malaysia.
Duties of the Malaysian Receiving Officer. In his capacity as liquidator of a company in winding up, he:
Place in his custody or under his control all property or things in action to which the company is entitled or found to be entitled to it
Submit an initial report to the Court after receiving a statement on management
Place a list of contributors unless the Court states otherwise
Place a list of contributors unless the Court states otherwise
Paying attention to any instructions given by resolution from creditors or contributories in any general meeting or by the inspection committee in handling the administration of the company’s assets in winding up
Exercise any other powers by the Companies Act 1965 given to the liquidator in the case of winding up
In his capacity as Receiving Officer, he:
- Supervise the external liquidators and take note of all their actions and if there are any complaints, they shall investigate the matter, and take any action as deemed appropriate
- May order an investigation to be made on the books and vouchers handled by the external liquidator
