Insolvency Notification System(INS)

Insolvency Notification System (INS)
1. The Insolvency Notification System (INS) is developed to replace preliminary notifications via postal mail by Jabatan Insolvensi Malaysia (MdI) to interested persons. Interested persons will be notified of the bankruptcy of an individual and winding up status of a company via INS on a daily basis. Interested persons will then be required to provide MdI with the information relating to the accounts belonging to a bankrupt or wound up company and surrender any remaining monies to the Director General of Insolvency as the administrator of a bankrupt or to the Official Receiver as the liquidator of a wound up company. Since the introduction of INS on 1 January 2014, more than 30 interested persons comprising of creditors, financial institutions, fund managements companies and government agencies have subscribed to INS.

2. Preliminary notifications regarding the bankruptcy of an individual and winding up status of a company can be viewed in INS by logging on to MdI e-Insolvensi portal. A list of bankruptcy of individuals and winding up status of companies will be uploaded by MdI within 24 hours after being notified of any Bankruptcy Order or Winding Up Order. The list will be available for viewing in INS for 14 days only.

3. In addition, interested persons will be required to furnish relevant information relating to the accounts belonging to a bankrupt or wound up company by using the format provided in INS. The said information can be provided to MdI by sending an email to the branch administering the case. Interested persons are also required to surrender any remaining monies belonging to a bankrupt to the Director General of Insolvency in accordance with subsection 55(5) of the Bankruptcy Act 1967 / Insolvency Act 1967 [Act 360] or belonging to a wound up company to the Official Receiver acting as the liquidator as provided under subsection 233(1) of the Companies Act 1965 / subsection 483(1) of the Companies Act 2016 [Act 777].
